LFC SOLD to NESV.

Re: LFC Sold to NESV (New England Sports Ventures)

4.04pm: JUDGE SAYS IT WOULD BE A "LITTLE AMBITIOUS" FOR THE CASE TO BE SETTLED BY FRIDAY. (In reply to Broughton's QC saying board would desperately like a verdict by then).
Why, for fuck's sake? His time wasting and futile arguments have been torn to shreads so fucking get on with it.

Re: LFC Sold to NESV (New England Sports Ventures)

We all want a quick resolution, but we have to remember that there's so much crap being shovelled that they have to be covered point by point.

Otherwise it will almost surely lead to an appeal where one party will claim that judge was in error when failing to addres a particular point.

true complexity of this case now clear - 5 qc's have now spoken - for rbs, h&g, lfc, Broughton, and nesv
Why?
Probably because Hicks cross-claimed against RBS and enjoined Broughton, Purslow, Ayre and NESV in his action

Judge says it would be ambitious for the case to be settled by Friday. Surely point of trial is to decide if #LFC board can sell by deadline

JenChang88
If not, then theoretically RBS should forego legalities and just take the club into administration Friday and sell to whom it likes.

Re: LFC Sold to NESV (New England Sports Ventures)

I dunno why you guys are suprised, anytime things are dragged through the court this way it's never quick or straight forward.

Re: LFC Sold to NESV (New England Sports Ventures)

9 points wouldn't usually be a great ask to get european football. CL is next years target.

(I can't believe were takling 2 years without cahmpions league football)

Re: LFC Sold to NESV (New England Sports Ventures)

I doubt any right thinking judge would give judgment in a rush. Friday sounds like he would be making one in a rush.

Even if it appeared to him that Hicks was pulling a fast one, he'd want to go over the evidence with a fine tooth comb to make sure his judgment doesn't get overturned on appeal.

Right now, I'd be happy for RBS to call in the debt tomorrow. Get the Fat Texan out of Anfield.

Re: LFC Sold to NESV (New England Sports Ventures)

I wonder if David "Moron" Moores is following the proceedings or perhaps he's out and about spending some of his additional eight million pounds.

People aren't that suprised. I'd say many merely hoped it would be all done quickly.

Change the record Wilko. If we'd have ended up with DIC they had plans to load us with debt too

Re: LFC Sold to NESV (New England Sports Ventures)

4.27pm: RBS QC: "RBS is a lender that deserves to be repaid £200m on Friday. It is wrong of Hicks and Gillett to try and delay that process."

4.25pm: QC for RBS says bank has been willing to wave "tens of millions of pounds in fees" to see a sale go through. Also dismisses G&H claim that there is no actual 15 October deadline with the Bank as part of their "game"

Re: LFC Sold to NESV (New England Sports Ventures)

So Hicks loses out whatever happens then? If RBS call in the loan he gets nothing and if we sell to Henry he gets nothing?

Surely there is no way he'll either stay in charge or make any money out of the club after all this?

Afraid I won't, Sunny. I doubt we'd be tuning in to a court case like this had those two fucking clowns not appealed to the fans to "Trust us" before selling LFC to this shite.

Re: LFC Sold to NESV (New England Sports Ventures)

Whether you are right or wrong in your theory Wilko I don't see how it helps right now.

Re: LFC Sold to NESV (New England Sports Ventures)

.30pm: While we wait for the next update from court, what does it mean if the court doesn't make its decision today, or indeed, this week (as seems distinctly possible given Mr Justice Floyd's recent comment)? Reuters says this:

If the Oct. 15 deadline for a refinancing of Liverpool's debt is missed, lawyers believe RBS could take control of the club and conduct the sale itself.
That could result in the holding company of the five-times European champions briefly being put into administration, which would result in the points deduction under Premier League rules.

Hindsight is fucking brilliant Wilko, DIC haven't covered themselves in glory and no one knows realistically if they were the better deal. Also, to be fair, Moores (and G&H for that matter) weren't to know there would be a Worldwide recession around the corner either.

DIC withdrew their offer.
H&G's offer was the only one to accept

Re: LFC Sold to NESV (New England Sports Ventures)

Maybe light at the end of the tunnel? 8)

It's still going on in that courtroom. RBS' QC just told the court, "RBS is a lender that deserves to be repaid £200m on Friday. It is wrong of Hicks and Gillett to try and delay that process."

RBS QC says the 15th October deadline does actually exist. More lies from Hicks and Gillett
RBS QC says the bank will waive millions of pounds in fees if a resolution is made before Friday.

It's not as if, at the time, the fans were begging Moores not to sell his shares. The vast majority of fans were desperate for Moores to sell.

Re: LFC Sold to NESV (New England Sports Ventures)

4.34pm: Our reporter on the spot, Sachin Nakrani summarises from court:

RBS says owners have contradicted rules of sales agreement by trying to oust two members of the board and there should be a mandatory injunction imposed by the court to make sure the board is reinstated.

G&H admit they have breached sales agreement but say they only did it because the board excluded them from the sales agreement and refused to take into account stronger alternative bids to NESV. As a result, they dispute the injunction claim.

The Board disputes the claim that the owners were excluded from the sales agreement and says that instead the owners simply refused to take part. It also insists the NESV bid was the strongest on the table after a thorough process to find a buyer for the club

That was a Hicks led consortium, which is different on paper to a Gillett/Hicks partnership. I'm sure other potential buyers or those involved in the various consortiums have had other ventures that have gone tits up.

Like I said, hindsight. Yeah it was a bad decision but quit with the 'Moore's sold us down the river' trip. He clearly loves the club, at least it always seemed pretty fucking obvious anyway.

Can we leave the dic debate to another thread as some of us are checking this for news from our phones.
