They are threatening legal action over Carroll's red card. I swear if they issue proceedings I will offer my services to them the next day. Cunt of a club, the striker is an overpaid fat joke, the manager is senile and their fans ought to be deported somewhere. But I am well up for it if they take this to court.

Andy Carroll: West Ham seek legal route over red card

West Ham are to take legal action after failing in their appeal to overturn the red card shown to Andy Carroll during the 1 February win against Swansea.

The Football Association upheld the decision which means the England striker is now banned for three games.

"There is nowhere to go other than to seek some kind of legal redress," said West Ham co-chairman David Gold.

Rules allow clubs to take disputes to arbitration and if necessary to the Court of Arbitration for Sport.

The FA has refused to comment on the latest development.

Carroll, 25, was sent off after clashing with Swans defender Chico Flores during his side's 2-0 victory.

He will now miss the Premier League games against Aston Villa, Norwich and Southampton.

In apparent reaction to the decision, Carroll, who set up both goals tweeted: "Disgraceful."

According to the FA, West Ham failed to prove to a three-man panel that referee Howard Webb had made "an obvious error" in dismissing Carroll after the forward's arm hit Flores's forehead.

However, West Ham manager Sam Allardyce was certain that Webb made a mistake.

"There has to be somebody to look at that in the cold light of day and say that is certainly not a red card," he said after the win.

Gold added: "We are hugely disappointed at the outcome of the process.

"The last thing I want to do is going to some kind of legal issue because I think it is a footballing issue.

"But we are fighting for our lives. If we were mid-table we would probably get on with it but we are fighting for our lives to retain our Premier League status and we owe it to our fans, we owe it to ourselves.

"We are upset, we feel we have been badly treated.

"Most judgements are not made by three people, they are made by 12 - that's why they are called juries.

"I believe if you had gone to the FA Council and asked the 100 members 75% would have said it was not a sending off, but if you just take three people it may not be representative."

West Ham are 18th in the Premier League, one point from safety. [/article]
 
I quite like West Ham. I definitely like Big Andy. I don't really think they have a case though. Harsh sending off, but not rescindable in my opinion.

Doesn't matter, if they act fast enough they can get a temporary injunction to stop the ban being served until the case is heard. Some good lawyers can long out the proceedings for several years. By the time it gets listed the retired Andy Carroll will be sat in some boozer in Newcastle telling his nephew about the days when he used to be a professional footballer.

The FA will look stupid as hell. I will take my cut. We're all winners.

Agree completely. He deffo lashed out. That Flores acted like a grade A thundercunt in his reaction though. Disagree with @dantes though. I quite like West Ham and big Andy.

That's easy to say after they took cole, downing and Carroll off our hands. But they also took the Olympic stadium off the tax payers hands. East London is largely a dump populated by scum.

For me it was a bit like the elbow you whack your little brother with. Done in such a way that there's a level of deniability and "oh sorry, accident!" As in that case its probably going to fail. As with Flores, the little brother throws himself on the floor and squeals for all he's worth.

I don't know where you live @dantes (In London maybe??) But that is bollox on an epic scale. It's annoying when people assume that much vaunted opinion of East London. Especially folk that live outside of the city or have never lived there at all. East London is fucking ace. You just need to avoid the ket squat parties on a Friday night and the occasional high jinx attempted mugging. Do that and it's a boss place to live .....

He added: "We are a club that understands there are rules and we abide by them. But you have every commentator and 80 per cent of the media saying it wasn't a sending off.
"Yet Howard Webb reviews the situation afterwards and says he stands by his judgement and when it goes to appeal and three guys stand by Howard Webb you feel 'how can this be right'.

Gold said Carroll's presence could be crucial for the rest of West Ham's season.
He said: "Of course it could. You can see the impact he has on our football club. I feel sorry for him as well - he was absolutely mortified.
"He was shrugging the guy off, okay he has messed his hair up but I don't think you should get sent off for messing somebody's hair up.
"There was a lovely tweet about Chico Flores saying he went to Vidal Sassoon and is now in intensive hair."

I don't think it stands a chance but I like that a club has decided to challenge the FA's arbitrary appeals process.
 
This could be an interesting case, because if they appeal to CAS, do the FA have to stay the ban? (which will probably serve the purpose for west ham, even if they lose).
But if they appeal it to CAS or someone and they uphold the appeal, and the FA have to overturn their ban, then the floodgates would open, maybe in a good way, where some of this ludicrous refereeing can be put to shame and sorted out. This bollocks where 'if the ref saw it and gave a yellow or didn't act then there's nothing we can do' bollocks might have to go.
Maybe every single game, and all the decisions, given by the ref or not, will have to go to a panel. so then cards can be overturned, and ones handed out retrospectively, might also open the door for banning people for diving.
 
Even more interesting if they get relegated and then try and get the FA to cough up compensation for what they think relegation has cost them. No chance of course, but will be entertaining to watch.
 
Oh look the FA are reconsidering... In other words consulting with their lawyers to check they are in the clear. I really do want to get my hands on them.

This. This would solve many of the problems of the game. Retroactive cards and, subsequently, bans would stop diving in a heartbeat. The refs could then be held accountable for their errors. 5 decisions overturned by the tribunal and it's off to the championship with you!

West Ham are truly pitiful. The FA should have increased it to 5 games for the reason that he obviously showed no remorse and would reoffend after a standard ban.
 
Agree with that as far as it goes, but we also need to be careful to nail the lie - because that's what it is - that he's any worse than loads of Prem defenders out there.
