Has anyone ruled out if it someone buying gilletes half that this due dilligance is on. For all we know it could be one of Hicks buddies buying in and thats why he has been given refinancing himself. Then all he needs to do is sack the board and then he could freely place the debt on the club.

That bolded bit doesn't follow. Hicks would have to convince any refinancing lender that he'd be good for the debt himself. It wouldn't matter a hoot if some pal of his had replaced Gillett.

I joined SoS last night. Whilst I have misgivings there's 'no' point me saying then here, at the meetings at least I can put that across. They're doing something at least, & their overall aim to get the yanks out is something I can't argue with.

I wont being taking militant action but anything else needs considering.

Whilst match boycotts are extreme I think it's what's needed.

The board can't vote against the principle of Hicks reaching an agreement with somebody else to refinance, which is nothing to do with them. What they can vote against is the idea of Hicks putting the club and its assets up as security for the relevant loan. They've already done so once and (fingers crossed) I can't see that changing. Hicks would therefore have to find other security instead, and I don't know what else he's got which would fit the bill after his sports teams in the US were taken away from him. That's the main reason why I think there's still hope that this rumour may come to nothing.

Sorry JJ, I missed that post. That makes sense, so in theory even if this rumour of him having found someone who's willing to refinance is spot on, it could still be a no go as the board will, hopefully, be unwilling to give him what he needs to secure the new loan.

In a nutshell. The $64,000 question is whether he has anything else available which could be acceptable as security.

Incidentally I managed to get some useful info.from a Manc mate of mine who e-mailed me to crow about Blackpool and the situation generally. He's a retired solicitor and, once he'd calmed down, I asked him one or two things about company law, particularly whether the board would be obliged to act in the interests of the shareholders (Hicks and Gillett) at all times. Turns out the answer is no, they wouldn't. In this guy's view it is possible for them to vote in a way which wouldn't suit H and G, provided they can demonstrate that doing what H and G want would damage the club. Apparently the word is that this is the broad thrust of the advice received by the majority on the board from London lawyers when they voted down Hicks' previous attempt to use the club as security for a refinance. (It also suggests Moores could have turned H and G's bid down right at the beginning, but let's not go there. >🙁)

that last bit is so mindblowingly obvious i don't know how anyone could ever have thought otherwise. i found those people (person, perhaps) suggesting the opposite at the time in defence of moores profoundly annoying and disingenuous.
